• The ownership of the dispensers and jars supplied to the Customers shall always vest with Kingdom Waters Private Limited (hereinafter referred to as “The Company”) and the Company shall have the right to reclaim the possession of the aforesaid dispensers or jars on the event of violation of any of these terms & conditions.
  • Without the prior written consent of the Company, Customer shall not assign, lend, pledge, sell, transfer, or sublease the dispensers and jars or the Lease, permit to exist any security interest, lien or encumbrance with respect to any of the dispensers and jars; or cause or permit any of the Equipment to be moved from the premises of the Customer.
  • It shall be the responsibility of the Customer to provide safe power connections, as per the recommend and stipulated product standards for the water dispenser, preferably within one meter of the dispenser.
  • The Customer shall maintain the dispensers and jars in good operating condition and the Customer shall protect the same from deterioration, other than normal wear and tear. The Customer shall use the dispensers and jars in the regular course of business only, within its normal capacity, without abuse, and in the manner contemplated only.
  • Usage of any other brand of water or liquid or 20-liter jar on this dispenser other than Aleph or one supplied by Kingdom Waters Private Limited is prohibited.
  • The Customer shall never fill any fluid in the jars provided.
  • The Customer shall desist from repairing the water dispenser.
  • Neither the Customer nor its employees, agents or representatives shall tamper with, disassemble, revise, engineer or otherwise examine the manual workings of the dispensers and jars.
  • The Customer shall not change or remove any insignia or lettering that is on the dispensers and jars or that is thereafter placed thereon indicating the Company’s ownership there of.
  • The Customer shall not make any “non – reversible” addition to the Dispensers and jars without the prior written consent of the Company.
  • The authorized personnel of the Company shall have the right during normal business hours, to enter the premises in order to inspect, observe or remove the dispensers and jars, and the customer shall cooperate fully in affording the personnel of the Company the opportunity to do the same.
  • The Customer shall authorize the Company to do additions, modifications, alterations, replacements and upgrades to the dispensers and jars as and when deemed required by the Company.
  • Upon the requirement to test the quality of the water provided, the act of taking a sample on Customer’s own accord is restricted and the assistance of the Kingdom water’s team shall be sought for the same and the team of the Company shall collect the sample and will hand it over to the customer.
  • The policy and pricing for ALEPH are both subject to change with ample prior notice, in the light of Company’s continuous pursuit for innovation and constant improvement.
  • The Company at its sole discretion reserves the right to
    discontinue the services to a Customer or stop supplies in a geographical territory, if the market situation warrants so or any other reason whatsoever.
  • The Customer shall retain a formal receipt from the delivery team, each time upon making the payment for the jars. As far as possible we recommend our Customers to make the top up payment only through our online platforms.
  • In the event of cancellation of the subscription, Customers are requested to give the Company prior notice and the Company shall within 15 days after the dispenser and jars are collected by the Company refund the deposit.
  • In the event of discontinuation of services by the Company, a prior notice shall be sent to the Customer and the deposit shall be refunded within 15 days after the dispensers and jars are collected by the Company.
  • The security amount deposited with the Company shall be reimbursed after assessing the damage to the dispensers and jars if any and the cost of such damages shall be deducted accordingly.
  • The Customer acknowledges that this Agreement does not confer on the Customer any rights to use the Company’s graphic designs, copyrights, trademarks, trade dress, trade secrets, know-how or any other intellectual property owned or controlled by the
    Company.
  • The Company shall not be responsible for any direct, indirect, incidental or consequential damages arising from possession or use of the dispensers and jars.
  • The company shall not provide for any transportation or bear any transportation cost for the servicing of dispensers and jars. Such services shall be performed only at the premises of the Customer.
  • The Customer shall indemnify the Company against any claims, actions, damages or liabilities arising out of or connected with the dispensers and jars, without limitation.
  • The Customer represents and acknowledges that the dispensers and jars are of a size, design, capacity and manufacture selected by it. The Company makes no warranty or representation whatsoever, express or implied, as to the merchantability, fitness for any particular purpose, design or condition of the dispensers and jars, or intellectual property rights (including without limitation any patent, copyright and trademark rights, of any third party with respect to the dispensers and jars, whether relating to infringement or otherwise) with respect to the dispensers and jars.
  • This contract shall be governed by the Indian Contract Act 1872 and any proceedings or actions arising out of this contract shall be heard and determined by any such courts at Trivandrum only.
